AFFILIATE AGREEMENT

This agreement describes the terms and conditions for participation in the IF LOST Tags Affiliate Program. The terms "Affiliate," "you," and "your" are referring to you, the applicant. "We" and "our" refer to IF LOST Tags Affiliate Program.  We are independent parties and this agreement will not form any partnership.

The Affiliate application is for individuals or businesses interested in receiving compensation when customers buy IF LOST Tags products because of your referral.  It is our way of saying thank you to those who are sharing positive word of mouth about the IF LOST Tags products.  

Affiliates are independent; they are not agents or employees of IF LOST Tags.  Affiliates are solely liable and responsible for payment of their own FICA, state and federal income taxes as applicable.  Furthermore, IF LOST Tags does not provide Affiliates with any type of life, automobile, accident or disability insurance, including workers compensation, State Accident Insurance Fund or any other type of insurance.  Affiliates shall be responsibility for his/her own supplies and means to promote or sell IF LOST Tags products.  As required by law, 1099 forms will be sent to Affiliates whose earnings have reached the required level.  

It is encouraged, not required, for Affiliates to purchase some IF LOST Tags products to familiarize themselves with the products and how they work in order to promote to others.

IF LOST Tags logos, pictures, product pictures, and designs are strictly copyrighted and trademark protected.  Affiliates shall not use any IF LOST Tags logos or pictures on business cards or print materials.  However, Affiliates may use their Affiliate link as well as state that they are “An Affiliate of IF LOST Tags” on business cards or print materials.

AGREEMENT DURATION
This agreement will begin upon our acceptance of your affiliate application and will end when terminated by either party.  IF LOST Tags will notify you in writing via email or mail.

Termination may happen at any time, with or without cause, by giving the other party written notice of termination.

MODIFICATION
By posting a Change Notice or a new agreement on this site, we may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available commission earnings, a change to the commission earning percentage, payment procedures, and Program rules. 

If any of the modifications are UNACCEPTABLE TO YOU, your only recourse is to terminate this Agreement. If you CONTINUE PARTICIPATION IN THE PROGRAM following the posting of a Change Notice or new agreement, it will be considered as your acceptance of the change.

COMMISSION EARNINGS
For commission earnings, you will receive 15% of the revenue from product orders placed through your Affiliate Site. You will not receive a percentage of the shipping and handling, only products sold.

Affiliate commission earnings will only be paid on sales which are made through qualified, active Affiliates.  For a sale to generate a commission to an Affiliate, the customer must complete the order form, remit full payment for the products ordered, and have their transaction completed and accepted. 

Commission earnings can only be earned between the acceptance of the Affiliate application and notice of termination. Affiliate commission earnings will be paid by IF LOST Tags via check to the Affiliate on the 10th of each month for the previous full month of Affiliate’s product sales. Any returned orders, returned checks, chargebacks, or fees from a returned order will be adjusted in the Affiliate’s following month’s commission earnings payment. If no commission earnings payment is due to Affiliate, a billing invoice for the amount of the chargeback will be issued.

Affiliates must have their IF LOST Tags Affiliate link active on their website (business website, personal blogs, Facebook, MySpace, etc).

ORDER PROCESSING
IF LOST Tags will be solely responsible for processing every order placed by a customer on the Affiliate sites. Customers who purchase products through IF LOST Tags will be deemed to be customers of IF LOST Tags.  Customers who purchase products through your Affiliate site will be considered referred by your Affiliate site and you will be compensated as described above. 

Prices and availability of our products and services may vary from time to time.  IF LOST Tags policies, sales, promotions, and coupons will always determine the price paid by the customer. We reserve the right to change our prices, shipping and handling, and offer sales at any time without notice.  We reserve the right to reject any order that does not comply with our rules, operating procedures and policies.

WEBSITE RESTRICTIONS
IF LOST Tags reserves the right to not accept any application into the IF LOST Tags Affiliate Program based on site content. Sites that do not qualify for the IF LOST Tags Affiliate Program include, but are not limited to, sites that are:

• X- rated and promote sexually explicit materials
• Promoting violence and discord.
• Promoting discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
• Promoting illegal or questionable activities
• Violating intellectual property rights
• SPAM (UCE)

Unsolicited Commercial E-mail – IF LOST Tags in no way participates in mass unsolicited e-mailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from the IF LOST Tags Affiliate Program. 

DISCLAIMER
We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the IF LOST Tags Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or down time.

This Agreement will be governed by the laws of the United States and the District of Columbia, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the Federal or State courts located in Redmond, Oregon, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns.

Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

By submitting this Affiliate Agreement form, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee, or statement other than as set forth in this agreement.

No commission is paid on your original purchase from IF LOST Tags. In other words you cannot buy from yourself or be your first purchase for the sole purpose of discounting your own product purchase.
